The term “miscellaneous sales” means any garage, basement, yard, rummage or other similar sale of five or more miscellaneous items originally purchased by the seller for his or her ultimate use or consumption.

All miscellaneous sales from or upon residential property shall conform to the following regulations:

(a)   No person as seller, or persons of the immediate family residing with the seller, shall have or conduct more than two miscellaneous sales within a 12 month period and such sale shall be limited to three consecutive days: provided, that schools, churches and nonprofit organizations may carry on miscellaneous sales for the benefit of the organization only, with no restriction on the number of days, when such sale is conducted on school or church property, or property of such nonprofit organization.

(b)   Signs advertising such sale shall not exceed two signs of 24 square inches and shall be displayed only on the property from which the sale is conducted and only during the days of the sale.

(c)   Where the sale is conducted on the premises exterior to any structure or residence, or on any vacant lot or tract, all sale items shall be removed from such exterior premises, lot or tract, within two days following the date the sale is concluded.

Violation of any of the provisions of this article shall constitute a misdemeanor and any person, firm or corporation upon conviction thereof shall be fined in any sum not exceeding $300 and each day of violation may be considered a separate offense.
