There is hereby incorporated by reference for the purpose of prescribing rules and regulations governing conditions hazardous to life and property from fire, hazardous materials or explosion, and for the purpose of providing minimum regulations for the construction, erection, remodeling, alteration, repair or expansion of any building or structure, the “International Fire Code,” 2018 Edition, including all appendices, prepared and published in book form by the International Code Council, Inc., except such articles, sections, parts or portions as are hereinafter deleted, modified or added. Any errata officially published by the International Code Council, Inc., shall become part of the International Fire Code when placed on file by the administrative authority. If any conflict or discrepancy exists between this article and the referenced International Fire Code, the provisions of this article shall rule.
No fewer than three copies of the International Fire Code shall be marked or stamped “Official Copy as Incorporated by Reference by the Code of the City of Newton, Kansas,” with all sections or portions thereof intended to be deleted, changed or amended clearly marked to show such deletion, change or amendment, and to which shall be attached a copy of this ordinance and filed with the city clerk to be open to inspection and available to the public at all reasonable hours. All administrative departments of the City charged with the enforcement of the ordinance shall be supplied, at the cost of the City, such number of official copies of such International Fire Code similarly marked, deleted and changed as may be expedient.

(a) Whenever the term “Uniform Fire Code” or “International Fire Code” is used in this chapter, it shall mean the fire code as adopted by Section 10-101 herein.
(b) Whenever the words “Authority Having Jurisdiction” (or “AHJ”) is used in the International Fire Code as adopted by Section 10-101 herein.
(c) Whenever the words “district” or “districts” are used in the International Fire Code as adopted by Section 10-101 herein, they shall mean either Fire Zone One or Fire Zone Two or both such Fire Zones as the context may indicate.

(a) Section 202 General Definitions of the International Fire Code, incorporated by section 10-101 of this article, is hereby amended to include the following defined terms, or to amend the existing definitions of such terms, as follows:
AIRCRAFT HANGAR. Means Residential Aircraft Hangar, Aircraft Maintenance Hangar or Aircraft Storage Hangar.
AIRCRAFT MAINTENANCE HANGAR. Means an aircraft hangar which includes the following activities: repair of aircraft; modification of aircraft; rebuilding of structural damage, correction of a system malfunction or replacement of a major component; aircraft engine overhaul and maintenance; welding operations; major disassembling, inspection, reassembling, and aircraft fuel tank or system repair or cleaning.
AIRCRAFT STORAGE HANGAR. Means an aircraft hangar which includes the following activities: routine service checks of aircraft; corrections of flight crew complaints as to aircraft; and minor repair and maintenance performed on an aircraft while it is in “out of flight” status.
BONFIRE. An outdoor fire utilized for ceremonial purposes that does not meet the criteria for a recreational fire.
PORTABLE OUTDOOR FIREPLACE. A portable, outdoor, gas fuel burning fireplace that may be constructed of steel, concrete, clay or other noncombustible material. A portable outdoor fireplace may be open in design, or equipped with a small hearth opening and short chimney or chimney opening in the top.
RESIDENTIAL AIRCRAFT HANGAR. Means an accessory building less than 2,000 square feet (186 m2) and 20 feet (6096 mm) in building height constructed on a one- or two-family property where aircraft are stored. Such use will be considered as a residential accessory use incidental to the dwelling.
SPECIAL AMUSEMENT BUILDING: A special amusement building is any temporary or permanent building or portion thereof that is occupied for amusement, entertainment or educational purposes and that contains a device or system that conveys passengers or provides a walkway along, around or over a course in any direction so arranged that the means of egress path is not readily apparent due to visual or audio distractions or is intentionally confounded or is not readily available because of the nature of the attraction or mode of conveyance through the building or structure. This term shall include any structure, facility or area or any part thereof including, but not limited to haunted houses, fun houses, spook houses, haunted caves or mansions, spook walks, and haunted forests. In determining whether the definition of special amusement building applies, it is immaterial as whether the operation is “for profit” or “non-profit.”
(b) The following amendments and additions to the International Fire Code, incorporated by section 10-101 of this Article, are hereby amended to read as follows:
Section 105.6.10 Cryogenic fluids. The storage of flammable cryogenic fluids is prohibited in Fire Zone One. An operational permit is required for the storage of flammable cryogenic fluids in Fire Zone Two.
105.6.16 Flammable and combustible liquids. An operational permit is required for storage of Class I and Class II liquids in light or general industrial areas in Fire Zone Two as defined in Section 6-147 of this code. Storage of Class rand Class II liquids of more than five gallons is prohibited in Fire Zone One.
Section 106.2.1 Inspection requests. It shall be the duty of the person requiring an inspection to notify the AHJ that such work is ready for inspection. The AHJ is authorized to require that every request for inspection be filed not less than two working days before such inspection is desired. Such request may be in writing or by telephone at the option of the AHJ. It shall be the duty of the person requesting any required inspection to provide access to and means for proper inspection of such work.
Section 107.5 Occupancy inspection. All new buildings or structures or occupancy changes in existing buildings or structures shall not be occupied prior to an inspection by the fire code official ensuring all applicable provisions of this code have been met.
307.3 Extinguishment authority. Where open flame creates or adds to a hazardous situation, or a required permit has not been obtained, the AHJ is authorized to order the extinguishment of the open flame operation.
307.4 Location. The location for open and recreational burning shall be not less than 100 feet from any structure, and provisions shall be made to prevent the fire from spreading to within 100 feet of any structure.
Exception: Fires in UL approved containers or containers constructed of noncombustible materials such as brick, stone, concrete, or metal with a pile size that is less than 3 feet in diameter and two feet in height. Flame length shall not exceed 2 foot in height. Containers can be located not less than 25 feet from a structure, combustible material, property line, deck, etc.
307.6 Burning Trash. Burning of trash, rubbish, paper, and plastic is prohibited. Only seasoned firewood may be burned for open and recreational burning.
307.7 Burning Ban. Burning not take place when there is a ban or moratorium on burning issued by federal, state, or local agencies.
307.8 Wind. Burning shall also be discontinued when the wind speed is in excess of 15 mph.
307.9 Spark Arrestor. The fire needs to be protected with a spark arrestor screen having a maximum ½ inch metal openings secured across the top of the fire pit or located on the vent or chimney.
307.10 Attended Fires. Open and recreational burning shall not occur unless attended at all times by a person 18 years of age or older.
307.11 Prohibited Burning. No material other than seasoned fire wood, propane, charcoal, natural gas or wood pellets shall be burned at any time in the City.
307.4.1 Bonfires. All bonfires must first be approved by the AHJ. A bonfire shall not be conducted within 100 feet of a structure or combustible material unless the bonfire is contained in a barbecue pit. Conditions that could cause a fire to spread within l00 feet of a structure or combustible material shall be eliminated prior to ignition.
307.4.3 Portable outdoor fireplaces. Portable outdoor fireplaces shall be used in accordance with the manufacturer's instructions and shall not be operated within 15 feet of a structure or combustible material.
307.1.1 Prohibited open burning. Open burning shall be prohibited when atmospheric conditions or local circumstances make such fires hazardous. Open burning shall be prohibited when wind speeds are greater than 15 MPH.
Exception: Prescribed burning for the purpose of reducing the impact of wildland fire when authorized by the fire code official.
308.1.4 Open-flame cooking devices. Charcoal, gas, and pellet grills shall not be operated on combustible balconies or within ten ( 10) feet of combustible construction.
Exception: One- and two-family dwellings.
308.1.6.3. Sky lanterns. A person shall not release or cause to be released an untethered sky lantern without the permission of the AHJ.
311.1.1 Abandoned premises. Buildings, structures and premises for which an owner cannot be identified or located by dispatch of a certificate of mailing to the last known or registered address, which persistently or repeatedly become unprotected or unsecured, which have been occupied by un-authorized persons or for illegal purposes, or which present a danger of structural collapse or fire spread to adjacent properties shall be considered abandoned, declared unsafe and abated by demolition or rehabilitation in accordance with the Code of the City of Newton, Kansas.
315.4 Outside storage. Outside storage of combustible materials shall not be located within 10 feet of a property line or 50 feet from a structure.
Exceptions:
1. The separation distance to the property line is allowed to be reduced to 3 feet for storage not exceeding 6 feet in height.
2. The separation distance to structures is allowed to be reduced to 10 feet if the pile does not exceed 6 feet in height.
3. The separation distance is allowed to be reduced when the code official determines that no hazard to adjoining property or any structure exists.
403.1 Standby personnel. When, in the opinion of the code official, it is essential for public safety in a place of assembly or any other place where people congregate, due to the number of persons or the nature of the performance, exhibition, display, contest or activity, the owner, agent or lessee shall employ one or more qualified persons, as required and approved by the code official to be on duty at such place. Such individuals shall be subject to the code officials orders at all times when so employed and shall be in uniform and remain on duty during the times such places are open to the public, or when such activity is being conducted. Before each perfom1ance or the start of such activity, such individuals shall inspect the required fire appliances provided to see that they are in proper place and in good working order and shall keep diligent watch for fires or other life safety hazards during the time such place is open to the public or such activity is being conducted, and shall take prompt measures to extinguish fires or perform life saving measures as necessary. Such individuals shall not be required or permitted, while on duty, to perform any other duties than those herein specified.
408.1 First emergency evacuation drill. The first emergency evacuation drill of each school year shall be conducted within 30 days of the beginning of classes.
408.2 Special amusement buildings. Special Amusement buildings shall comply with all provisions of the International Fire Code, including the requirements of Sections 401 through 406, and the following additional requirements:
Exception: Special Amusement buildings or portions thereof that are without walls or a roof and constructed to prevent the accumulation of smoke are exempt from the requirements set forth in Section 408.12. A special amusement building will qualify for an exception only after being approved by the fire code official.
408.3 Automatic fire detection. Special amusement buildings shall be equipped with an automatic fire detection system in accordance with Section 907.
408.4 Automatic sprinklers. Special amusement buildings shall be equipped throughout with an automatic sprinkler system in accordance with Section 903.3.1 and 903.1.1.
Exception: Automatic fire sprinklers are not required where the total floor area of a temporary special amusement building is less than 1,000 square feet and the travel distance from any point to an exit is less than 50 feet.
408.5 Alarm. Actuation of a single smoke detector, the automatic sprinkler system or other automatic fire detection device shall immediately sound an alarm at the building at a constantly attended location from which emergency action can be initiated including the capability of manual initiation of requirements in Section 907.2.12.1.
408.6 Emergency voice/alarm communications system. An emergency voice/alarm communications system shall be provided in accordance with Section 907.2.12.3, which is also permitted to serve as a public address system and shall be audible throughout the entire special amusement building.
408.7 Exit marking. Exit signs shall be installed at amusement building required exit or exit access doorways. Approved directional exit markings shall also be provided. Where mirrors, mazes or other designs are utilized that disguise the path of egress travel such that they are not apparent, approved low-level exit signs and directional path markings shall be provided and located not more than 8 inches above the walking surface and on or near the path of egress travel. Such markings shall become visible in an emergency. The directional exit marking shall be activated by the automatic fire detection system and the automatic sprinkler system in accordance with Section 907.2.12.2.
408.8 Interior finish. The interior finish shall be Class A in accordance with Section 803.1.
408.9 General requirements. When the maze concept is used, there shall be no dead-end corridors and there shall be an obvious exit out of the maze every twenty feet (20') of linear travel. All stairways shall be illuminated at a level of at least one foot-candle 408.10 Groups of children age 12 and under must be accompanied or supervised by a staff person who is 18 years of age or older. Such groups shall consist of not more than 20 persons. The staff person must have in their possession an operable flashlight and shall be familiar with the special amusement building including the layout and emergency provisions.
408.11 There shall be no smoking allowed at any time by anyone inside the special amusement operation or other similar installation. No smoking signs shall be posted.
408.12 All electrical installations shall meet the requirements of the electrical code.
408.13 The fire code official shall be contracted prior to the operation of the special amusement operation or other similar installation for an inspection and planning of evacuation procedures. A plan shall be provided to and approved by the fire code official to accommodate all safety procedures, including a diagram of all entries and exits.
408.14 The total number of occupants at any time shall be limited to the number allowed by the fire code official after the inspection has been performed.
408.15 Open flame devices and temporary heaters are prohibited in or around all special amusement buildings.
408.16 Emergency lighting shall be approved by the fire code official.
408.17 Tunnels shall not be lower than three feet (3'), or longer than four feet (4'). All tunnels must include a removable lid.
408.18 Parking shall not limit access to emergency apparatus.
408.19 A telephone shall be installed for emergency use.
408.20 The use of Visqueen plastic sheeting, polyethylene sheeting or similar plastic sheeting is strictly prohibited.
507.5.1 Where required. Where a portion of the facility or building hereafter constructed or moved into or within the jurisdiction is more than 400 feet from a hydrant on a fire apparatus access road, as measured by an approved route around the exterior of the facility or building, on-site fire hydrants and mains shall be provided where required by the fire code official.
901.4 Installation and authorized installers. Fire protection systems shall be maintained in accordance with the original installation standards for that system. Required fire protection systems shall be extended, altered, or augmented as necessary to maintain and continue protection whenever the building is altered, remodeled or added to. Installations or alterations to fire protection systems shall be done in accordance with applicable standards and only by companies with NICET Level II fire alarm qualifications, as well as sprinkler contractors qualified and registered with the State Fire Marshal's Office. Companies installing, altering or testing fire alarm systems must be NICET Level II qualified.
901.4.7 Plan Review. A plans examination by the fire code official is required for any new installation, addition, or alteration of any fire sprinkler system, fire alarm system, or kitchen hood system. Plans and specifications shall be submitted to the fire department for review and approval prior to construction.
901.6 Inspection, testing and maintenance. Fire detection, alarm and extinguishing systems shall be maintained in an operative condition at all times, and shall be replaced or repaired where defective and shall be subject to annual test by a fire protection contractor. Non-required fire protection systems and equipment shall be inspected, tested and maintained in the same manner as required systems. The fire protection contractor shall provide a letter stating the result of the test and corrections of the fire protection system to the fire department.
903.2.8 Group R. An automatic sprinkler system installed in accordance with Section 903.3 shall be provided throughout all buildings with a Group R fire area.
Exception: One and two family dwellings and town houses two stories or less when built in accordance with the International Residential Code.
903.2.11.1.1 Opening requirement and access. Openings must have at least 5.7 square feet of clear opening and be approved by the AHJ. Such openings shall be accessible to the fire department from the exterior and shall not be obstructed in a manner that firefighting or rescue cannot be accomplished from the exterior.
1104.5 Illumination emergency power. The power supply for means of egress illumination shall normally be provided by the premises' electrical supply. In the event of power supply failure, illumination shall be automatically provided from an emergency system for the following occupancies where such occupancies require two or more means of egress:
1. Group A having more than 50 occupants.
2. Group B buildings three or more stories in height, buildings with 100 or more occupants above or below the level of exit discharge, or buildings with 1,000 or more total occupants.
3. Group E in interior stairs, corridors, windowless areas with student occupancy, shops and laboratories.
4. Group F having more than 100 occupants.
5. Group I.
6. Group M.
Exception: Buildings less than 3,000 square feet in gross sales area on one story only, excluding mezzanines.
7. Group R-1.
Exception: Where each guestroom has direct access to the outside of the building at grade.
8. Group R-2 as applicable in Section 1001.1.
Exception: Where each living unit has direct access to the outside of the building at grade.
9. Group R-4.
Exception: Where each sleeping room has direct access to the outside of the building at ground level.
3107.17 Standby Personnel. When, in the opinion of the Fire Code Official, it is essential for public safety in a tent, canopy or membrane structure used as a place of assembly or any other use where people congregate, because of the number of persons, or the nature of the performance, exhibition, display, contest or activity, the owner, agent or lessee shall employ one or more qualified persons, as required and approved, to remain on duty during the times such places are open to the public, or when such activity is being conducted.
Before each performance or the start of such activity, standby personnel shall keep diligent watch for fires or other life safety hazards during the time such place is open to the public or such activity is being conducted and shall take prompt measures to extinguish fires or perform life saving measures as necessary and assist in the evacuation of the public from the structure.
Such individuals shall not be required or permitted, while on duty, to perform any other duties than those herein specified.
5504.3.1.1.3 Location. Stationary containers shall be located in accordance with Section 5503. Containers of cryogenic fluids shall not be located within diked areas containing other hazardous materials. Storage of flammable cryogenic fluids in stationary containers inside or outside of buildings in Fire Zone One is prohibited and a permit is required from the Chief of the Newton Fire/EMS Department for inside or outside storage of flammable cryogenics in Fire Zone Two.
5604.1.1 Storage Limits. The storage of explosives and blasting agents is prohibited within Fire Zone One and Fire Zone Two. This prohibition shall not apply to wholesale and retail stocks of small arms ammunition, black powder, smokeless powder, and small arms primers for hand loading small arms ammunition for personal consumption. Display and storage in Group M occupancies shall be regulated by Section 5606.5.
5704.4 Locations where above ground tanks are prohibited. Storage of Class I and Class II liquids in above ground tanks outside of buildings is prohibited in Fire Zone One as defined in Section 6-147 of the Code of the City of Newton, Kansas. A permit is required from the Chief of the Newton Fire/EMS Department for storage of Class I and Class II liquids in above ground tanks in Fire Zone Two as defined in Section 6-147 of the Code of the City of Newton, Kansas, for I-1 and I-2 districts.
5706.6.2 Unattended Parking. No operator of a commercial delivery vehicle such as a box van, bob tail, truck trailer or tank truck containing products classified by federal, state or local regulatory agencies as hazardous materials, including but not limited to explosives and blasting agents, compressed gases, flammable and combustible liquids, flammable solids, oxidizers, organic peroxides, pyrophoric material, unstable reactive materials, water reactive materials, cryogenic fluids, highly toxic and toxic materials, radioactive materials, corrosives, health and biomedical hazards and irritating materials, shall park or leave such vehicle unattended on any street, highway, avenue or alley within five hundred feet (500') of any residential area, apartment or hotel complex or educational, hospital or health care facility at any time, or at any other place that would, in the opinion of the chief, present a life or property hazard.
Exceptions: This shall not prohibit parking or absence of the operator (1) in connection with loading or unloading, (2) for meals during the day or night if the street is well lighted at the place of parking and (3) for the purpose of securing assistance in case of emergency.
6104.2 Maximum capacity within established limits. The storage of Liquefied Petroleum Gas in containers over 20 pound capacity is prohibited in Fire Zone One as defined by Section 6-147 of this code except for recreational trailers or vehicles. The storage for Liquefied Petroleum Gas over 20 pound capacity including forklifts, vehicles and recreational trailers is allowed in Fire Zone Two in light or general industrial districts. The aggregate capacity of any one installation shall not exceed a water capacity of 2,000 gallons.
Exception: ln particular installations, this capacity limit shall be determined by the Fire Code Official, after consideration of special features such as topographical conditions, nature of occupancy, proximity to buildings, capacity of proposed containers, degree of fire protection to be provided and capabilities of the local fire department.
Appendix A. Board of Appeals
SECTION A101 GENERAL
A101.1 Board of Appeals established. In order to determine the suitability of alternate materials and type of construction and to provide for reasonable interpretations of the provisions of the IFC, there shall be and hereby is created a board of appeals consisting of five (5) members who are qualified by experience and training to pass upon pertinent matters and who are not employees of City of Newton Fire/EMS. The fire chief and/or fire marshal of Newton Fire/EMS shall attend each meeting of the board of appeals and shall be available to defend decisions made by the fire chief and/or fire marshal to provide technical information to the board of appeals, but neither the fire chief nor the fire marshal shall have a vote upon any matter before the board of appeals. The city attorney shall provide legal counsel for the board of appeals. The board of appeals shall be appointed by the governing body of the city of Newton to serve at its pleasure and each board member so appointed shall serve for a term of three (3) years. In the event of the death, resignation or disqualification of any member of the board of appeals, such member's successor shall be appointed as herein provided to fill only the un-expired term caused by the vacancy. The board of appeals shall adopt reasonable rules and regulations for conducting its investigations. The code official shall act as the secretary of the board and shall keep a detailed record of all its proceedings, which shall set forth the reasons for its decisions, the vote of each member, the absence of a member and any failure of a member to vote. The board of appeals shall render all findings and decisions in writing to the fire chief with a duplicate copy to the applicant or appellant.
A101.2 Limitations on authority. An application for appeal shall be based on a claim that the intent of this code or the rules legally adopted thereunder has been incorrectly interpreted, the provisions of this code do not fully apply, or an equivalent method of protection or safety is proposed. The board shall have no authority to waive requirements of this code. In making its decision, the board of appeals shall consider the degree of safety to be achieved and any resulting detriment to the public welfare, and if available, the board of appeals shall use established standards of nationally recognized laboratories and research organizations.
A101.3 Qualifications. The board of appeals shall consist of members who are qualified by experience and training to pass on matters pertaining to hazards of fire, explosions, hazardous conditions or fire protection systems and are not employees of the jurisdiction. Examples of professions providing suitable experience or training include the following: (a) architects licensed by the state of Kansas; (b) NICT Level II fire alarms supervisors; (c) mechanical engineers licensed by the state of Kansas; (d) fire sprinkler installers for sprinkler companies which are qualified and registered with the State Fire Marshal's Office; and (e) contractors with a Class A license and who are currently licensed by the City of Newton.
A101.4 Application of appeal. All appeals shall be made in writing to the chief of the fire department within ten (10) calendar days of the pronouncement of the decision being appealed from, or be forever barred. Any applicant or appellant desiring to use alternate materials or types of construction shall guarantee payment of all expenses for tests deemed necessary by the board of appeals.
A101.5 Conflict of interest. Members with a material or financial interest in a matter before the board shall declare such interest and refrain from participating in discussions, deliberations, and voting on such matters.

(a) The International Fire Code as adopted and amended herein shall be enforced by the Bureau of Fire Prevention in the Newton Fire/EMS Department of the City of Newton which is hereby established and which shall be operated under the supervision of the Chief of the Newton Fire/EMS Department or by such officers as may be delegated by the Chief. The Chief shall designate a fire marshal and such other members of the Newton Fire/EMS Department as inspectors and as “Fire Code Officials” under the International Fire Code as the Chief may deem necessary from time to time, which may include the authority and power to sign, issue and execute complaints regarding violations of this chapter of the Code of the City of Newton. The Chief shall also possess all such powers and authority.
(b) With the advice and recommendations of the Fire Chief, the governing body of the City may from time to time by Resolution establish and authorize a program for the periodic inspection of one or more classifications of structures or facilities within the City for the enforcement of the laws and ordinances governing the same, and for the safeguarding of life a property from hazards and dangers under the jurisdiction of the Newton Fire/EMS Department.
(c) The Fire Chief, and any and all inspectors and code officials designated by the Fire Chief under the authority conferred herein, shall have the right of access to any and all properties, structures, and facilities in the City for the purpose of carrying out the adopted and authorized periodic inspection program as established by the governing body. It shall be unlawful for any owner, manager or occupant of any such property to fail or refuse to provide such access upon reasonable advance notice and request for such access having been given. Furthermore, the Fire Chief, and any designated inspector or code official, may make application to the District Court for an administrative search warrant to compel such access, and may make forcible entry upon or into any such property, structure or facility for the purpose of carrying out such inspection, as such warrant may authorize.

(a) Any person who violates any of the provisions of the this Article or of the Uniform Fire Code as adopted and amended herein, or who fails to comply therewith, or who violates or fails to comply with any order made thereunder, or who builds in violation of any detailed statement of specifications or plans submitted and approved thereunder or any certificate or permit issued thereunder and from which no appeal has been taken, or who fails to comply with such order as affirmed or modified by the Board of Appeals or by a court of competent jurisdiction within the required time, shall severally for each and every such violation and noncompliance, respectively, be guilty of a misdemeanor, punishable by a fine fixed by the court at a sum not to exceed $500 or by imprisonment of not more than 30 days or by both such fine and imprisonment. The imposition of one penalty for any violation shall not excuse the violation or permit it to continue; and all such persons shall be required to correct or remedy such violations or defects within a reasonable time; and when not otherwise specified, each ten days that prohibited conditions are maintained shall constitute a separate offense. The application of the above penalty shall not be held to prevent the enforced removal of prohibited conditions.
(b) Whenever the Chief of the Newton Fire/EMS Department or any code enforcement officer delegated with such authority has probable cause to believe that a person, firm or corporation is committing or has committed a violation of any provision of this Article or of the Uniform Fire Code, the Chief or such enforcement officer may first cause a notice of violation(s) and order(s) to comply to be served upon such person, firm or corporation responsible therefor. Such notice:
(1) Shall be in writing;
(2) Shall include a description of the real estate and/or the street address where the violation allegedly occurred or is occurring sufficient for identification;
(3) Shall specify the violation(s) which exist and the correction(s) ordered; and
(4) Shall prescribe a reasonable time for the performance of any act it requires.
Such notice shall be deemed to be properly served upon such alleged violator if a copy thereof is delivered to such alleged violator personally, or if a copy is left at such alleged violator's place of abode or business with a person of suitable age and discretion who shall be informed of the contents thereof. Such notice shall also be deemed to be properly served if a copy thereof is sent by mail to such alleged violator's last known address, or, if the copy is returned showing it has not been delivered, a copy thereof is posted in a conspicuous place in, on or about the building or structure affected by the notice.
(c) In case any notice of violation(s) and order(s) to comply authorized herein is not complied with, the Chief or such enforcement officer may request the City Attorney to institute an appropriate action or proceeding against such person, firm or corporation responsible for the violation(s):
(l) To restrain, correct or remove the violation or to compel such person, firm or corporation to refrain from any further execution of work;
(2) To restrain or correct the erection, construction, installation, alteration, enlargement, addition, repair, relocation, replacement, improvement, removal, conversion, demolition, equipping, maintenance, occupation or use of a building, structure or portion thereof;
(3) To require the removal of work in violation;
(4) To prevent the maintenance, occupation or use of the building, structure or portion thereof, erected, constructed, installed, altered, enlarged, added to, repaired, relocated, replaced, improved, removed, converted, demolished, equipped, maintained, occupied or used in violation of this Article or of the Uniform Fire Code, or in violation of a plan or specification under which an approval, permit or certificate was issued.
In addition, or in the alternative, the Chief or such enforcement officer may proceed for the enforcement of penalties hereunder.
(d) For the purposes of the penalty provisions under the Uniform Fire Code, every violation shall be deemed to be a class G violation except for the following which shall be classified as follows:
