A CHARTER ORDINANCE EXEMPTING THE CITY OF NEWTON, KANSAS, FROM THE PROVISIONS OF K.S.A. 1974 SUPP. 12-621 AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS ON THE SAME SUBJECT, EMPOWERING AND AUTHORIZING SAID CITY TO PROVIDE FOR ONE OR MORE SYSTEMS OF SEWAGE DISPOSAL WORKS AND TO BUILD, OPERATE AND MAINTAIN SAID DISPOSAL WORKS AND TO REBUILD, ENLARGE, MAKE ADDITIONS THERETO AND AUTHORIZING AND PROVIDING FOR THE PAYMENT OF THE COSTS AND EXPENSES THEREOF.
Section 1. The City of Newton, Kansas, a City of the first class of less than 80,000 population, by the power vested in it by Article 12, Section 5 of the Constitution of the State of Kansas, hereby elects to exempt, and does exempt, itself from, and makes inapplicable to it, K.S.A. 1974 Supp. 12-621 and hereby provides substitute and additional provisions therefor, as hereinafter set forth in this Ordinance. Said referenced provision being an enactment, or a part thereof, which is applicable to said City, but is not applicable uniformly to all cities.
Section 2. The Governing Body of the City of Newton, Kansas, shall have the power to provide for one or more systems of disposal works for the purification of the sewage of said City or any part thereof, to build, rebuild, enlarge and make additions to said disposal works and to operate and maintain said disposal works as the Governing Body may designate from time to time. The costs and expenses of the building, rebuilding, enlargement and additions to said disposal works shall be borne by the City as a whole, and may be paid out of the general revenue fund; or if the Governing Body may so determine, improvement bonds of the City may be issued therefor in any sum not exceeding three hundred thousand dollars ($300,000) and the proceeds from the sale of such bonds be used in paying the same: Provided, That such bonds shall be issued as provided by law.
