A CHARTER ORDINANCE EXEMPTING THE CITY OF NEWTON, KANSAS, FROM THE PROVISIONS OF K.S.A. 41-501(h) LIMITING OCCUPATION OR PRIVILEGE TAXES WHICH MAY BE IMPOSED BY CITIES UPON MANUFACTURERS, DISTRIBUTORS, FARM WINERIES, RETAILERS AND NONBEVERAGE USERS OF ALCOHOLIC LIQUOR AS ESTABLISHED BY K.S.A. 41-501(h).

Section 1. By the power vested in the City of Newton, Kansas, by Article 12, Section 5, of the Constitution of the State of Kansas, said city hereby elects to exempt itself from and make inapplicable to it the occupation and privilege tax limitation provisions as to manufacturers, distributors, farm wineries, retailers and non-beverage users of alcoholic liquor as prescribed by K.S.A. 41-501(h), such provisions being a part of an enactment applicable to the City of Newton, but not applicable uniformly to all cities.
