A CHARTER ORDINANCE AMENDING SECTION 3 OF CHARTER ORDINANCE NO. 24 OF THE CITY OF NEWTON, KANSAS, CHANGING THE AMOUNT OF THE TRANSIENT GUEST TAX WHICH MAY’ BE LEVIED BY THE CITY; REPEALING EXISTING SECTION 3 OF CHARTER ORDINANCE NO. 24; AND REPEALING CHARTER ORDINANCE NO. 32.

Section 1. That Section 3 of Charter Ordinance No. 24 be changed and amended to read as follows:

“Section 3. Transient Guest Tax. A transient guest tax shall be levied in the city, at a rate not to exceed five percent upon the gross rental receipts derived from or paid by transient guests for lodging or sleeping accommodations, exclusive of charges for incidental services or facilities in any hotel or motel. The percentage and effective date of such tax shall be determined by the governing body and shall be specified in a resolution authorizing the same.”

Section 2. Section 3 of Charter Ordinance No. 24, and Charter Ordinance No. 32 in its entirety, are hereby repealed as of the effective date of this charter ordinance.
