CHAPTER I. ADMINISTRATIONCHAPTER I. ADMINISTRATION\ARTICLE 6. OATHS AND BONDS

All officers of the city, whether elected or appointed, either under the laws of the State of Kansas or ordinances of the city, shall, before entering upon the duties of their respective offices, take and subscribe an oath or affirmation as follows:

       “I do solemnly swear (or affirm, as the case may be) that I will support the Constitution of the United States and the Constitution of the State of Kansas and faithfully discharge the duties of __________ (here enter name of office). So help me God.”

Each member of the board of commissioners shall, before entering upon the duties of office, give a good and sufficient corporate surety bond, to be executed by a responsible bonding company authorized to do business in Kansas, payable to and for the use and benefit of the City of Newton, in the sum of $5,000, conditioned for the faithful discharge of his or her duties, and that he or she will save the city harmless from all loss caused by his or her neglect of duty or malfeasance in office, or for the willful expenditure or misappropriation of any moneys, property or securities of such city in violation of law. Bonds in each case before being accepted shall be approved by the Judge of the District Court in and for Harvey County. The cost of such surety bond shall be borne by the city.

The governing body shall provide for coverage by blanket bond of the following officers and employees in the amount of $5,000:

(a)   City Clerk;

(b)   Assistant City Clerk;

(c)   Water Department Clerks (3);

(d)   Inspection Department Clerk;

(e)   Finance Clerks;

(f)   Municipal Court Clerk;

(g)   Swimming Pool Manager;

(h)   Parking Meter Collector;

(i)    Cemetery Superintendent;

(j)    Airport Manager.

The city treasurer provided for in section 1-407 of this code shall, before entering upon the duties of the office of city treasurer, give a good and sufficient surety bond in the amount of $50,000.

Each of the bonds required by section 1-603:604 herein, shall be conditioned for the faithful performance of duty and of all acts required by the laws of Kansas and the ordinances of the city, and for the application and payment over to the proper persons of all moneys or property coming into possession of each such officer by virtue of his or her office.

All bonds given to the city shall be approved as to their form by the city attorney and as to surety and sufficiency by the governing body, unless otherwise provided by the laws of the State of Kansas.

All performance, fidelity or official bonds required to be given to the city, or State of Kansas, by any ordinance of the city, excepting those governing municipal court procedure shall be corporate surety bonds executed by responsible bonding companies authorized to transact business in the State of Kansas and no personal surety or security shall be accepted on any such undertakings, except municipal court recognizances or appeal bonds; provided, that in the event the person furnishing such bond is unable to procure a corporate surety thereon for the reason that surety companies refuse to act as sureties on account of the conditions contained in such bond, then the city commission, if it deems it advisable, may accept personal sureties upon such bond or bonds. Refusal of three surety companies to write such a bond shall be conclusive evidence that the person furnishing such bond cannot obtain a corporate surety thereon; and all bonds with personal sureties thereon shall be for a term of not to exceed one year.
