A CHARTER ORDINANCE EXEMPTING THE CITY OF NEWTON, KANSAS, FROM THE PROVISIONS OF KS.A. 12-1222 REQUIRING THE MAYOR TO SERVE AS EX-OFFICIO MEMBER OF THE LIBRARY BOARD.

Section 1. By the power vested in said city by Article 12, Section 5, of the Constitution of the State of Kansas, said city hereby elects to exempt itself from and make inapplicable to it, the following provisions of K.S.A. 12-1222, to-wit:

       “…In addition to the appointed members of the board the official head of the municipality shall be ex-officio a member of the library board with the same powers as appointed members ...”

which appears in the last sentence of the first paragraph of said statute. Such referenced provision being a part of an enactment which is applicable to this city, but not applicable uniformly to all cities.
