A CHARTER ORDINANCE EXEMPTING THE CITY OF NEWTON, KANSAS, FROM THE RETAILER’S LICENSE FEE PROVISIONS OF K.S.A. 1979 SUPP. 41-2702(d) AND (f) AND PROVIDING SUBSTITUTE AND ADDITIONAL PROVISIONS THEREFORE.

Section 1. By the power vested in said city by Article 12, Section 5, of the Constitution of the State of Kansas, said city hereby elects to exempt itself from and make inapplicable to it the retailer’s license fee for sale and consumption of cereal malt beverages on the premises, prescribed by K.S.A. 1979 Supp. 41-2702(d) and the retailers license fee for sale of cereal malt beverages in original and unopened containers and not for consumption on the premises as prescribed by K.S.A. 1979 Supp. 41-2702(f), and to provide substitute and additional provisions in place thereof as hereinafter set forth. Such referenced provision being a part of an enactment applicable to the City of Newton, but not applicable uniformly to all cities.
